These Terms and Conditions (“Terms”) govern the contractual relationship between PIEDRA NATURAL a.s. (“Seller”, “we”, “us”) and any customer (“Buyer”, “you”) when purchasing goods through our online store available at www.els-moto.com (“Store”).
By placing an order, you confirm that you have read, understood, and agree to these Terms.
1. Scope of Application
1.1 These Terms apply to all sales contracts concluded between the Seller and the Buyer through the Store.
1.2 These Terms are provided in English and the contract is concluded in English, unless we explicitly offer and agree on another language version.
1.3 These Terms apply to purchases made by:
- Consumers – any natural person acting outside their trade, business or profession.
- Businesses – any legal entity or natural person purchasing in the course of their trade, business or profession.
1.4 These Terms do not apply to service agreements such as repair, installation or custom services, which are subject to separately agreed conditions.
2. User Account
2.1 You may place an order with or without creating a user account.
2.2 If you register an account, you must provide accurate and complete information and keep your login credentials confidential. You are responsible for all actions taken under your account.
2.3 We may suspend or delete your user account, in particular if you breach these Terms, misuse your account or remain inactive for more than 12 months.
3. Product Information and Availability
3.1 Product descriptions, images and information provided in the Store are for informational purposes. Minor variations in colour, texture or other details may occur, especially with natural materials.
3.2 All prices are displayed in the currency shown in the Store (e.g. EUR) and include VAT where applicable, unless stated otherwise.
3.3 Prices, availability and product specifications may change at any time. The price valid at the time of placing the order applies.
3.4 We are not obliged to conclude a contract for products that are incorrectly priced or no longer available. In such cases we will inform you and, if applicable, refund any payment already made.
4. Ordering Process and Contract Formation
4.1 To place an order, add products to your cart, proceed to checkout, fill in the required information and select your preferred delivery and payment method.
4.2 Before confirming the order, you can review and modify all details. Please check your order carefully before submitting it.
4.3 After receiving your order, we will send you an order confirmation by e-mail. The sales contract is formed when you receive this order confirmation.
4.4 For deliveries outside your country, additional delivery costs, customs charges or duties may apply. You will be informed of such costs before the goods are dispatched, where reasonably foreseeable.
4.5 We reserve the right to refuse or cancel an order, for example in case of suspected fraud, obvious pricing errors, unavailability of goods or failure to successfully process payment.
5. Prices, Payments and Delivery
5.1 Payment Methods
We may offer one or more of the following payment methods (as displayed in the Store at checkout):
- Payment card (credit or debit)
- Bank transfer (prepayment)
- Online payment gateways (e.g. GoPay or other providers)
- Cash on delivery (where available)
- Cash payment at our physical store (where available)
5.2 Unless stated otherwise, the purchase price is due upon order confirmation. Some payment methods may require payment prior to dispatch of the goods.
5.3 The goods remain our property until the purchase price is paid in full.
5.4 Delivery
5.4.1 We deliver to EU Member States as specified in the Store. Available delivery options and costs are shown during checkout before you complete your order.
5.4.2 Delivery times depend on product availability and destination. Any delivery dates provided are estimates unless expressly indicated as guaranteed.
5.4.3 Upon delivery, please check the condition of the packaging. If you notice visible damage or signs of tampering, we recommend that you record this with the carrier and, if necessary, refuse the parcel.
5.4.4 If you fail to accept or collect the goods without a valid reason, we may charge reasonable storage costs, any re-delivery costs, or cancel the contract and refund the purchase price minus any costs incurred.
6. Right of Withdrawal (Consumers Only)
6.1 If you are a consumer, you have the right to withdraw from the contract within 14 days without giving any reason.
6.2 The withdrawal period expires 14 days after:
- the day on which you or a third party indicated by you (other than the carrier) receives the goods, or
- in the case of multiple items ordered in one order and delivered separately, the day on which you receive the last item.
6.3 To exercise the right of withdrawal, you must inform us of your decision to withdraw from the contract by an unequivocal statement (e.g. by e-mail). You can contact us at:

6.4 Returning the Goods
After submitting the withdrawal notice, you must return the goods to us without undue delay and in any event no later than 14 days from the date on which you communicated your withdrawal.

6.5 Goods should be returned complete and in reasonable condition. You are responsible for any reduction in the value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
6.6 You bear the direct cost of returning the goods, unless we clearly state otherwise in the Store or in the order confirmation.
6.7 We will refund all payments received from you in connection with the purchase, including standard delivery costs (but not any extra costs resulting from your choice of a non-standard delivery method), without undue delay and no later than 14 days from the day we receive the returned goods or you provide proof that you have sent them back, whichever is earlier.
6.8 Refunds will be made using the same means of payment as you used for the initial transaction, unless we expressly agree otherwise; in any event, you will not incur any fees as a result of such refund.
6.9 Exclusions from the Right of Withdrawal
The right of withdrawal does not apply to, for example:
- goods made to your specifications or clearly personalised,
- goods which are liable to deteriorate or expire rapidly,
- sealed goods which are not suitable for return for health protection or hygiene reasons and which were unsealed after delivery,
- goods which, after delivery, are according to their nature inseparably mixed with other items.
6.10 The above list is not exhaustive; we will always follow the mandatory consumer protection rules applicable in your EU Member State.
7. Warranty and Liability for Defects
7.1 If you are a consumer, you are entitled to a legal guarantee for faulty products in accordance with applicable EU law, in particular Directive (EU) 2019/771 on certain aspects concerning contracts for the sale of goods.
7.2 The Seller is liable for any lack of conformity existing at the time of delivery or which becomes apparent within 24 months after delivery.
7.3 This guarantee does not cover:
- normal wear and tear,
- damage caused by misuse, improper installation or failure to follow instructions,
- defects resulting from changes or modifications made by the Buyer,
- defects for which a reduced price was agreed and which were clearly disclosed before purchase.
7.4 In the event of a defect, you may be entitled to:
- repair of the goods,
- replacement of the goods,
- an appropriate price reduction, or
- a refund in case of a serious defect or if repair or replacement is impossible or disproportionate.
7.5 For business customers, a shorter warranty period and different liability rules may apply as specified in individual contracts or as permitted by applicable law.
7.6 Claims can be submitted by e-mail at info@els-moto.com or at our operational address stated above. Please provide your order number, a description of the defect and, if possible, photographs or other documentation.
8. Personal Data Protection (GDPR)
8.1 We process personal data in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and other applicable data protection rules.
8.2 We use your personal data in particular for:
- processing and delivering your orders,
- fulfilling our legal obligations (e.g. accounting, tax),
- providing customer support,
- sending marketing communications, if you have given your consent or if allowed by law.
8.3 Personal data may be shared with third parties only where necessary (e.g. payment providers, logistics partners, IT service providers) and always under appropriate contractual safeguards.
8.4 You have the right to request access to your personal data, rectification, erasure, restriction of processing and portability, as well as the right to object to processing in certain cases.

9. Dispute Resolution
9.1 We aim to resolve any disputes amicably. If you have a complaint, please contact us first at info@els-moto.com.
9.2 If you are a consumer residing in the European Union, you may use the EU Online Dispute Resolution (ODR) platform for resolving disputes with us: https://ec.europa.eu/consumers/odr.
9.3 If a dispute cannot be resolved amicably, the competent courts of the EU Member State where the Seller is established shall generally have jurisdiction, without prejudice to mandatory consumer protection rules that may grant jurisdiction to courts in your country of residence.
10. Governing Law
10.1 These Terms and any contracts concluded under them are governed by the laws of the EU Member State where the Seller is established, without prejudice to any mandatory consumer protection rights granted by the laws of the EU Member State where you reside.
11. Final Provisions
11.1 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
11.2 We may update these Terms from time to time. The version published in the Store at the time of your order applies to your purchase.
11.3 These Terms are effective as of the date of their publication in the Store.
